1. Acceptance of Terms

By accessing or using Maidily ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

2. Description of Service

Maidily provides software for managing cleaning businesses, including scheduling, customer management, invoicing, and related tools. The Service is provided "as is" and may be modified at any time.

3. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Keep your password confidential and secure
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Violate any applicable laws or regulations
  • Infringe on the rights of others
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or servers
  • Upload malicious code or content
  • Use the Service to send spam or unsolicited communications

5. Text Messaging and Communications

5.1 Consent to Receive Messages from Maidily

By providing your mobile phone number and using the Service, you expressly consent to receive text messages (SMS and MMS) from Maidily related to your account and services, including but not limited to:

  • Appointment reminders and confirmations
  • Service arrival notifications
  • Payment reminders and receipts
  • Schedule changes and updates
  • Account notifications and security alerts

Message frequency varies based on your scheduled services and account activity. Message and data rates may apply. You may opt out of non-essential messages at any time by replying STOP to any message. Reply HELP for assistance. Opting out of transactional messages (such as security alerts) may require closing your account.

Your mobile phone number and opt-in data will not be shared with or sold to third parties or affiliates for marketing or promotional purposes. We may share your information with service providers who assist in delivering messages (such as our telecommunications provider), solely for the purpose of providing the Service.

5.2 Consent and Opt-In for End Customers

End customers consent to receive SMS messages when they create an account, make a booking, or provide their phone number through the Maidily platform. During registration or booking, end customers are informed that by providing their phone number, they agree to receive SMS notifications from their service provider via Maidily. End customers must have a valid account or booking to receive SMS messages. We do not send unsolicited marketing messages via SMS.

5.3 Opt-Out

You may opt out of receiving text messages at any time by replying STOP to any message. Upon opting out, you will receive a single confirmation message acknowledging the request, including the sender's business name and confirmation that no further messages will be sent. The following opt-out keywords are supported: STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, and QUIT. You may also manage your notification preferences in your account settings or contact us at help@maidily.com. Opt-out requests are processed as soon as practicable, and no later than 10 business days after the request is made.

5.4 HELP Keyword Support

Replying HELP to any message will return a response that includes the sender's business name, contact information for customer support, and instructions for how to opt out.

5.5 For Service Providers Using Our Messaging Features

If you are a service provider using Maidily's messaging features, you acknowledge that all messages are sent via A2P (Application-to-Person) 10DLC messaging and are subject to carrier regulations, the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, and CTIA Messaging Principles and Best Practices. You are responsible for:

  • Obtaining explicit, campaign-specific consent from your customers before sending any text messages — consent cannot be a condition of purchase or service, and must not be bundled with or obscured within other terms
  • Disclosing the following in your opt-in call-to-action: your business name, message types and purpose, expected message frequency, that "Message and data rates may apply," and how to opt out (e.g., "Reply STOP to cancel")
  • Using an unchecked (not pre-selected) checkbox or equivalent clear affirmative action when collecting consent via web forms
  • Never purchasing, renting, or using shared opt-in lists — consent must be obtained directly by your business
  • Maintaining records documenting when, where, and how consent was obtained from each customer
  • Ensuring the first message to each new customer includes: your business name, message types, frequency, "Message and data rates may apply," opt-out instructions (e.g., "Reply STOP to unsubscribe"), and help instructions (e.g., "Reply HELP for help")
  • Supporting HELP keyword responses that include your business name, customer support contact information, and opt-out instructions
  • Honoring all opt-out requests as soon as practicable, and no later than 10 business days, in accordance with FCC regulations
  • Using your own branded domains for any links in messages — public URL shorteners (e.g., bit.ly, tinyurl) are prohibited in initial messages
  • Not sending messages containing prohibited content including illegal substances, gambling, hate speech, or phishing

5.6 Mobile Information Privacy

No mobile information — including phone numbers and opt-in data — will be shared with or sold to third parties or affiliates for marketing or promotional purposes at any time. Mobile information may only be shared with service providers who assist in delivering messages, solely for the purpose of providing the messaging services. Service providers using Maidily's messaging features must maintain a similar commitment in their own privacy policies regarding their customers' mobile information.

5.7 Messaging Compliance Enforcement

Maidily monitors messaging activity for compliance with these Terms, carrier regulations, and applicable law. Violations of messaging policies — including spam complaints, opt-out violations, or prohibited content — may result in warnings, temporary suspension, or permanent termination of messaging capabilities. You are responsible for any fines, penalties, or carrier surcharges resulting from your non-compliance with messaging regulations.

6. Payment Terms

If you subscribe to a paid plan, you agree to pay all fees associated with your plan. Fees are billed in advance on a monthly or annual basis depending on your selection. All payments are non-refundable except as required by law or as explicitly stated in these Terms.

We reserve the right to change our pricing at any time. We will provide notice of any price changes before they take effect on your next billing cycle.

7. Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

  • Your subscription will remain active until the end of your current billing period
  • You will not receive a refund for any unused portion of your subscription
  • Your data will be retained for 30 days after cancellation, then deleted

8. Intellectual Property

The Service and its original content, features, and functionality are owned by Maidily and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You retain ownership of any data you input into the Service. By using the Service, you grant us a limited license to use your data solely to provide the Service to you.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAIDILY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY.

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Maidily and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Service or violation of these Terms.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
